(c) he is resident in the Sambalpur district andbelongs to any of the following tribes: -

1. Bauri. 3. Bhumij. 5. Turi.

APPENDIX D

Statutory Recommendations

PART I

A. The Provincial Government may at any time bynotification apply the provisions of Part II of this Chapteror of any of its sections to such areas as may be specifiedin the notification, being areas in habited by any of thetribes named in Schedule A (and hereinafter referred to as"the tribes").

B. (1) The number of representatives of the tribes inthe Provincial Legislature shall not be less in proportionto the total number of representatives than the populationof the tribes in the Province bears to its total population.

(2) In the Federal Legislature (House of the People)there shall be such number of representatives of the tribesof each Province as may be in accordance with the totalpopulation of the tribes in that Province on the scaleprescribed in Section.

C. The election of the representatives of the tribes tothe Provincial Legislature shall be by universal adultfranchise.

PART II

D. As from the commencement of this Constitution theprovisions of this Part shall apply to the areas specifiedin Schedule B to this Chapter (and hereinafter referred toas "the Scheduled Areas").

E. (1) The Provincial Government may, if so advised bythe Tribes Advisory Council, by notification direct that anylaw passed by the Legislature shall not apply to a ScheduledArea or shall apply with such modifications as it mayprescribe:

Provided that the Provincial Government shall, if soadvised by the Tribes Advisory Council, direct that any lawpassed by the Provincial legislature in respect of thefollowing subjects, that is to say, (i) all social mattersincluding inheritance of property; (ii) occupation of land(not being forest reserved under the provisions of theIndian Forest Act or other law applicable) including tenancylaws, allotment of land, reservation of land for anypurpose; (iii) village management, including theestablishment of village panchayats, shall not apply to aScheduled Area or shall apply with such modifications as itmay prescribe with the concurrence of the said Council.

(2) The Provincial Government may, in consultation withthe Tribes Advisory Council, make special regulations for aScheduled Area on any matter not provided for by a law inforce in the Area.

F. Vacant land in a Scheduled Area which is theproperty of the State shall not be

allotted to a non-tribalexcept in accordance with rules made by the ProvincialGovernment in consultation with the Tribes Advisory Council.

G. (1) The Provincial Government may, and if so advisedby the Tribes Advisory Council shall, direct that no personshall carry on business in a Scheduled Area as a moneylenderexcept under and in accordance with the conditions of alicence issued by it or by an officer authorised by it inthis behalf.

(2) Any contravention of an order issued by theProvincial Government under sub-section (1) of this Sectionshall be an offence.

H. The revenue and expenditure pertaining to aScheduled Area which is credited to or met from the funds of the Provincial Government shall be shown separately in theannual financial statement of the Provincial Government.

I. There shall be paid out of the revenues of theFederation such capital and recurring sums as may benecessary to enable the Provincial Government to meet thecost of such schemes of development as may be undertakenwith the approval of the Federal Government for the purposeof raising the level of administration of the ScheduledAreas and all round development of the tribes to that of therest of the province.
